Family Residence Permit

Any person who is not a citizen in a country has specific rights within the framework of international laws and in line with the countries' own legal systems. The most significant rights and obligations for non-citizens of a country are certainly the residence permits. The concept of residence can be explained legally by the place where individuals show their will to live. Persons who live in a country and who are not citizens of that country have to inform the competent authorities of the country where they live. Residence notification, which is a statutory obligation for everyone who is not a citizen of the country, is also a requirement for nationals of that country.

Residence permits, which are essential to maintain the legal order of a country, can be defined as documents which furnish a foreign citizen with the right to live for a certain period of time within the relevant country. The residence permit issued through the competent authorities can be arranged together with the requirements set by the laws of the countries in which foreign citizens wish to be granted a residence permit.

What is Family Residence Permit?

The residence permits for foreigners who want to live in Turkey are issued for those who desire to reside in Turkey for a long time. There are different ways to be granted a residence permit in Turkey. Family residence permits, which are one of the different residence permit means , are a type of residence permissible valid for those who have married Turkish citizens with a residence permit in Turkey or who have married persons who are included within the scope of Article 28 of Law No. 5901.

To Whom is Family Residence Permit Granted?

Family residence permits are granted to foreign spouses of sponsors in Turkey and to children who need care, provided that children of the sponsor or spouse are not major (adult). According to Article 28 of Law No. 5901, those with a residence permit, refugees and persons with secondary protection status are considered as sponsors. Article 28 of the related law comprises the following issues: persons who have obtained Turkish citizenship by birth but who have lost their Turkish citizenship through the permit of renouncement of nationality and  their children whose proceedings  on the same subject with them are made, continue to benefit from all of the same rights granted to Turkish citizens with the condition that all provisions relating to national security and public order are reserved except for the rights such as obligation of making the military service, electing and being elected , access to public duty, importing household items or vehicles by being exempted, while all of their acquired rights as to social security are reserved and provided that they are subject to the provisions contained in the relevant laws on the ability to use these rights.

Who Can Act As Sponsor For Family Residence Permit?

In the family residence permits, it is required to have a Turkish citizen or a foreigner who is legally resident in Turkey and who is referred to as a sponsor and can undertake the expenses of the foreigners coming to Turkey for the purpose of family reunification and who has been shown as a reference in the applications of those who demand residence permit. The persons listed below can be sponsor:

  1. Turkish Citizens,
  2. People with Blue Cards,
  3. People who have one type of residence permit (residence permits are classified as long-term residence permit, short-term residence permit, family residence permit, residence permit for victims of human trafficking, student residence permit  and  humanitarian residence permit .)
  4. Persons who have an international application for protection and those who have an identity document which is recognized as a place of residence in the law, except for conditional refugees,
  5. Refugees and persons with secondary protection status.

Where Are Family Residence Permit Applications Made?

The residence permits demanded by laws of the Republic of Turkey can be granted by applying to the Turkish consulates located in the countries where the citizens of the foreigners are residing or legally resident according to the system which is planned to be put into practice in the near future. However, foreign residents need to go to the governorships of the place they reside within the Turkish state border for all the residence permit applications they will make until this proceeding is put into practice.

Family Residence Permit Application Periods

Foreigners who have entered Turkey with a visa or visa exemption and who do not have a residence permit must apply for a residence permit which will be valid for them within 180 days subsequent to their completion of their 90 days of staying. Applications made for family residence permits are granted within a certain period due the workload intensity of governorates. The family residence permit extension application period must start 60 days before the family residence permit expires and must be done before the permit expires. Applications of foreign national applicants who have not yet applied for a family residence permit although their family residence permit has expired and with reasonable excuses are accepted. Residents who have not filed an extension application although their family residence permit has expired without any excuse will be subject to a residence permit tax and penalty for the period between their residence permit expiration date and their application date.

How Are The Approved Family Permit Documents Distributed?

Approved family residence permit documents are issued through the General Directorate of Immigration and posted to the residence addresses of foreigners by virtue of PTT (General Directorate of Turkish Post).

What Do People Have to Do When Their Family Residence Permit Expire?

If a foreign citizen having a family residence permit still maintains the conditions for residence permit when the residence permit thereof has expired, such foreign citizen can extend the residence permit thereof through the governor of the provinces where they reside or may have issued another type of residence permit if he or she has a new status and if he or she meets the conditions for another residence permit without the need to go outside Turkey.

What Is The Validity of Family Residence Permit?

The family residence permit is granted for two years beginning from the date of the grant. The validity of the family residence permit cannot exceed the period of residence permit of the sponsor.

Can Children of Families Who Have Received a Family Residence Permit Receive Educational in Turkey?

Children under the age of 18 living in Turkey under the name of family residence permit, have the right to receive education in primary and secondary schools. Children who have stayed in Turkey with a family residence permit for at least three years can switch to a short-term residence permit to claim it when they are 18 years old.

In this case the family residence permit may only be supplied to only one of the spouses and all of the children.

Under which conditions will Family Residence Permit Be Canceled?

Family residence permits of persons may be canceled under specific circumstances. Family residence permits will of persons currently residing in Turkey will be canceled in cases specified in Article 36 of Law No. 6458. According to this;

  1. A family residence permit shall be cancelled when conditions set out in paragraph one of Article 35 and again when conditions set out in paragraph three of Article 35 of Law No. 6458 for foreign nationals are not met or no longer apply.
  2. If the person requesting the family residence permit has a valid non-deportation court order or is banned from entering Turkey the family residence permit thereof will be canceled.
  3. The family residence permit is canceled if the family residence permit is determined to have been used for any purpose other than the purpose for which it was granted.
  4. The family residence permit is canceled if the person holding the family residence permit is found to have been abroad for more than one hundred eighty days in the last year.
  5. Permission for a family session is canceled if the family is found to have made a fake marriage.

Under which conditions will Family Residence Permit Requests Be Rejected?

The request for family residence permit of those demanding family residence permit is rejected under  the following circumstances:

 

  1. A family residence permit shall be cancelled when conditions set out in paragraph one of Article 35 and again when conditions set out in paragraph three of Article 35  of Law No. 6458 for foreign nationals are not met or no longer apply.
  2. If the person requesting the family residence permit has a valid non-deportation court                        order or is banned from entering Turkey the family residence permit thereof will be              canceled.
  3. Permission for a family session is canceled if the family is found to have made a fake                         marriage.
